Placing Cosmetic products on the market

From the September 1, 2002 it is not mandatory to register cosmetic products in Estonian Health Board. This means that manufacturer and importer has the full responsibility to ensure compliance with requirements for cosmetic products, including health safety and correct labelling.

Monitoring over cosmetic products is carried out as in-market controls (market surveillance).
Cosmetic products are controlled by inspectors of Health Board and Consumer Protection Board.

Requirements of cosmetic products are regulated by the Minister of Social Affairs with following regulations: Regulation No 32, from 01.01.2010 ’’The labeling requirements for cosmetics’’ and Regulation No 21 from 23.02.2007 ’’Requirements for cosmetic products and their handling’’. Necessary information for manufacturers and importers is available in those regulations.

According to the previous regulations manufacturer or importer of cosmetic products should have the following documentation:

  1. Quantitative and qualitative composition of cosmetic products;
  2. Fragrance and perfume name, code and information about raw materials supplier;
  3. Specifications (in the sense of EVS-EN ISO 9000:2001) of the product’s and raw material’s physical, chemical and microbiological indicators and control criterias of product purity and microbiology;
  4. A description of the manufacturing methods;
  5. Health safety assessment of the product;
  6. Name and address of the person, responsible for the safety assessment;
  7. Information about the side-effects;
  8. Data proving the efficiency of the product.

Regulation of the Minister of Social Affairs No 21 ’’Requirements for cosmetic products and their handling’’ states that manufacturer or importer of the cosmetic product must inform Health Board about manufacturing or importing the cosmetic products. For this purpose manufacturer or importer has to fulfill the notification form which is together with the guidance how to fill the form is available in standard of ’’Notification of cosmetic products, manufacture and import’’.
