Regulation (EC) No 304/2003 of the European Parliament and the Council considering the export and import of dangerous chemicals was adopted on 28th of January 2003 relating to the Rotterdam Convention considering PIC procedure. On 17th of June 2008 it was amended by
Regulation (EC) No 689/2008 of the European Parliament and of the Council.
According to the
Chemicals Act (in Estonian) §7 section 2(2) Health Board is a designated national authority for performing administrative functions and administrative acts based on Regulation (EC) No 689/2008 of the European Parliament and of the Council concerning the export and import of dangerous chemicals on banned and severely restricted chemicals.
The objectives of this Regulation are to implement the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, to promote shared responsibility and cooperative efforts in the international movement of hazardous chemicals in order to protect human health and the environment from potential harm and to contribute to the environmentally sound use of hazardous chemicals.
According to the Regulation (EC) No 689/2008 the concept of
export is the permanent or temporary exportation of a chemical from customs territory of the Community;
import is the physical importation of chemical to the customs territory of the Community.
